Abstract

PayPal is a payment method that is widely used by the international community. PayPal is a American multinational company based in San Jose, Californ United States that provides money transfer services via electronic mail, replacing the old method of using paper, checks and postal orders. However, PayPal does not yet have clear regulations in Indonesia. The formulation of the problem discussed is the legal aspect of using PayPal as an international transaction and the legal consequences in using transactions in Indonesia. This research is normative juridical research using a statutory and regulatory approach and a context approach. The sources of legal materials include primary legal materials and secondary analysis materials, and the analysis technique used is descriptive qualitative. The research results concluded that the use of PayPal in Indonesian law is in accordance with Bank Indonesia Regulation concerning Electronic Money and Bank Indonesia Regulation concerning Implementation of Payment Transaction Processing. PayPal users have no obligation to comply with domestic law because the ITE Law states that parties to a dispute are free to determine the law and resolution forum that will be applied.
