Abstract

Abstract

Trading using the mu'athah system is a transaction where both parties agree on the price and goods through direct action without uttering the contract of ijab and qabul. However, sometimes one party may utter the contract during the process. The advancement of technology in today's era has changed the way of doing business, especially in buying and selling transactions. Transactions now can be done more conveniently, where implementation no longer even requires ijab and qabul as before. Transactions using the mu'athah system itself often occur in daily life, such as buying and selling through vending machines, supermarkets, and so forth. Imam Abu Hanifah believes that trading with this system is permissible, as a transaction is considered valid if there is agreement and consent from both parties. He argues that trading with the mu'athah system can be done through actions if it has become a widely known common practice among the community. Because it is widely known by the community, it can indicate agreement or consent, either from both parties or from one party, towards the actions or deeds that occur.
