Abstract

The framework of Maqashid Syari'ah is divided into; (1) al-Dharuriyah (primary needs), is the enforcement of religious and worldly interests. Furthermore, Dlaruriyah is divided into five points commonly known as al-kulliyat al-khamsah, namely; (a) maintaining religious interests (Hifdzu al-Din), (b) maintaining the soul (Hifdzu al-Nafs), (c) maintaining the mind (Hifz al-Aql), (d) maintaining descendants (Hifdzu al-Nasl), (e) maintaining property (Hifdzu al-Mal). (2) al-Hajiyaat (secondary needs), is defined as things needed to realize convenience and eliminate difficulties that can cause danger and threats. (3) al-Tahsiniyah (tertiary needs), is carrying out good habits and avoiding bad ones according to what is known by common sense.
